rip off means kind of steal idea. For example, Dexter believed that Axl Rose 'ripped off' his hair with braids, so he joked around saying he was gonna 'rip off' Axl Roses new album called Chinese Democracy, but as we all know it was called Splinter.

Im not sure if they can. Green Day attempted to sue my friend cos his sites logo was the american idio grenade but blue. He changed it in end though.

sorry, but you guys are kind of stupid... the offspring didn't invent that skull. Do you know how album art is decided for major labels 99% of the time? A whole bunch of people whose job is to design album art sit in their office coming up with art... when a band wants to release an album, they sort through thousands of different album designs. The offspring saw the skull and chose it for co1, and paid to distribute it. It's not THEIR patent- it's the patent of the person who designed it. That person's goal is to sell their designs as much as possible. Therefore, that person very well could've sold that design to whoever made that shirt. Or the person made that design, too, and sold it to them. Lastly, seeing as the design is NOT the same, the patent most likely doesn't even apply to that because the colors are different, and the design is slightly different. The offspring does not have rights to that design, so no, they can not sue for that.

Actually, it isnt the same logo. So Offspring cant sue. But it is a very big rip off.

That is true. They changed it. Like when you look at something on the internet or in a magazine and they show the exact same thing as something you recognize. I once saw a Finding Nemo nemo thing on a resturaunt menu and they put this white glare on its fin so it wouldn't be the exact "nemo". It is safe though if they have the (R) or TM.

I've seen tons of designs similar to that before and after CO1 came out. It's one of those things that seems like it's ripped off because there's not much variation you can do with a logo like that, but I highly doubt it was intentionally ripped off.

All I'll say is that it is the Offspring skull with a bottom jaw and bones behind it, I've seen similar things which have the Offspring skull.

It is a bit of a rip off, not all flaming skulls I've seen look like the one we all know and associate with the Offspring. Besides, the Offspring skull, I don't believe, has been trade marked... And the people who created the design for the shirt are pretty much safe from having legal action taken against them... It's just parodizing something... Which is legal to do... Even without the permission from the owner of what is being parodized.

And if anyone says anything about Weird Al getting permission most, if not, all the time... He doesn't have to... He just wants to try and stay on good terms with the artists he parodizes.

The resemblence is striking, but it isn't exactly the same, even if the two bones and jaw were removed, it isn't exactly alike, which in cases dealing with parodies, is usually what it comes down to.

I know what you mean, Ive got this shirt, flames on the bottom and a exact image of the Offspring skull and the circle around it, like the CO1 album cover skull, yet its not Offspring licensed, I dont care though.
